Family Violence Trial Postponed

The criminal trial for the 22-year-old Millersville man accused of stabbing his mother was postponed.

The trial for James Arthur Zito, the 22-year-old Millersville man who allegedly stabbed his mother in July 2012 and then fled the home, was postponed on Tuesday.

Zito's criminal trial in Anne Arundel County Circuit Court in Annapolis was originally scheduled to take place Tuesday morning. Kristin Fleckenstein, a spokeswoman for state's attorney office, said the state's case against Zito has been postponed.

"The case postponed yesterday because defense attorney filed a NCR," Fleckenstein said. "That is basically a motion that the defense attorney files where he is trying to say to the court my client has mental health issues and is not criminally responsible for this case."

Zito faces charges of first- and second-degree assault, reckless endangerment, false imprisonment, arson threat and having a dangerous weapon with the intent to injure.

Another date for the trial has not been set.
